1. Agreement to Terms By accessing or using Freelancer5.com ("Platform"), you agree to these Terms of Service ("Terms"). If you disagree, do not use the Platform.
2. Eligibility You must be at least 18 years old and capable of forming legally binding contracts. By registering, you confirm you meet this requirement.
3. Account Responsibilities
Provide accurate, current information during registration.
Maintain account security (passwords, 2FA). You are liable for all activity under your account.
Notify us immediately of unauthorized use.
4. User Conduct & Prohibited Activities Users must not:
Post false, misleading, or illegal gigs/services.
Infringe intellectual property rights (copyrights, trademarks).
Use the Platform for spam, fraud, harassment, or discriminatory content.
Reverse-engineer, scrape, or disrupt the Platform’s functionality.
Solicit users off-platform to avoid fees (e.g., direct payments).
5. Seller (Freelancer) Obligations
Deliver services as described in your Gig.
Communicate professionally with buyers.
Comply with all applicable laws (e.g., tax regulations).
Only use licensed software/assets in your work.
6. Buyer (Client) Obligations
Provide clear requirements and timely feedback.
Pay for services as agreed.
Respect intellectual property rights of sellers.
7. Fees & Payments
Freelancer5.com charges a service fee on transactions (e.g., 5-20% of the Gig price).
Payments are processed via third-party providers (e.g., Stripe, PayPal).
Funds are held in escrow and released to sellers upon buyer approval.
All fees are non-refundable except as required by law.
8. Intellectual Property Rights
Platform Content: Freelancer5.com owns all rights to the Platform, including logos, text, and design.
User Content: Sellers retain rights to their work but grant Freelancer5.com a license to display it for marketing/service delivery. Buyers receive usage rights as specified in the Gig.
9. Dispute Resolution
Users must attempt to resolve disputes directly.
If unresolved, contact Freelancer5.com support. We may mediate but are not obligated to do so.
Final decisions rest with Freelancer5.com.
10. Limitation of Liability Freelancer5.com is not liable for:
Indirect, incidental, or consequential damages.
User interactions (e.g., disputes between buyers/sellers).
Third-party service failures (e.g., payment processors). Our total liability is capped at the fees you paid in the prior 6 months.
11. Termination We may suspend or terminate accounts for violations of these Terms, fraudulent activity, or at our discretion. Terminated users may not re-register without permission.
12. Governing Law These Terms are governed by the laws of [Your State/Country], without regard to conflict-of-law principles.
13. Indemnification You agree to indemnify Freelancer5.com against claims arising from your use of the Platform, breach of these Terms, or violation of others’ rights.
14. Changes to Terms We may update these Terms at any time. Continued use after changes constitutes acceptance. Material changes will be notified via email or Platform alerts.
